Relationship property and divorce
We provide advice for those entering and ending relationships. We, and/or our
friends at Terrace End Law (a law firm that specialises in Family law within the
same business group), can assist with contracting out agreements and division
of relationship property upon separation or divorce.
Contracting out agreements
A couple has the option to divide their assets differently to what is set out in the Property (Relationships) Act 1976. They can achieve this through a contracting out agreement (or “Pre-nup”). Using a contracting out agreement is the only legally binding way of dividing relationship property if the relationship ends, other than resorting to court.
Relationship property agreements
Upon separation or divorce, a couple may divide property by way of a relationship property agreement. This is otherwise known as a settlement agreement.
